Data Use

III.B. That the Restricted Data will be used solely for the purposes specified in the Research Plan previously approved by the Panel Study of Income Dynamics.

That Receiving Institution will use its best efforts to insure that no persons other than those identified in this contract, or in subsequent amendments to this contract, as Investigator, Co-Investigator, or Research Staff, will be permitted access to the contents of Restricted Data files or any files derived from Restricted Data files.

Inspections & Penalties

Penalty

III.Q. If the University of Michigan determines that this Agreement has been violated, it may,

1. Prohibit any of the signatories of this Agreement, and of any Supplemental Agreements with Research Staff, from obtaining access to any Data Files.

2. Report the violation(s) to the Receiving Institution's office responsible for conduct violations of or the safeguard of confidential information.

3. Utilize such other remedies as may be available to it under law or in equity.

III.P. That representatives of the University of Michigan shall have the right to enter the premises of the Receiving Institution for purposes of assessing compliance with this Agreement. In addition to other remedies for noncompliance provided in this Agreement or otherwise under law or in equity, Receiving Institution will be liable for the expenses of the University of Michigan and the Panel Study of Income Dynamics for such audit if Receiving Institution is found to be in noncompliance with this Agreement.

Publication

Cite/acknowledge data

III.J. To include in each written report or other publication based on analysis of Restricted Data from the Panel Study of Income Dynamics, the following statement:

"Some of the data used in this analysis are derived from Restricted Data Files of the Panel Study of Income Dynamics, obtained under special contractual arrangements designed to protect the anonymity of respondents. These data are not available from the authors.

Disclosure Requirements

I. G. "Restricted Data" includes any data from the Panel Study of Income Dynamics that might compromise the anonymity or privacy of respondents to that study. Specifically, it includes any data file that, for either individuals or families, includes identification numbers or demographic information (such as age, ethnicity, occupation, industry, gender, etc.), and

H. Information regarding the specific counties in which individuals or families resided, including the identification codes for the counties or any exact counts (total or for any specific characteristic) of the number of persons, families, households, or housing units in the counties and

I. Information regarding the specific neighborhoods (census tracts, Block Numbering Areas, Enumeration Districts, Minor Civil Divisions/Census County Divisions, Census Places, or 5-digit ZIPCodes) in which individuals or families resided, including the identification codes for the neighborhoods or any exact counts (total or for any specific characteristic) of the number of persons, families, households, or housing units in the neighborhood and

J. Information on Medicare claims of the individuals in the study.

K. "Data File" includes data in any form, whether on paper, CD-ROM or other electronic media.

No case listings in publications

The Data Protection Plan must carefully describe how researchers and staff members will avoid inadvertent disclosure of respondents' Medicare data and geographic locations or identity in all working papers,publications, and presentations.

At minimum, researchers must agree to exclude from any type of publication or presentation, the following information:
* Listing of individual cases;
* Description of individual cases;
* Listing, description, or identification of a tract or tracts by number, by name, or by descriptive information;
* Maps with any features (such as landmarks, road networks, original tract shape or physical features) that allow tracts to be identified; and
* Summary statistics or tabulations by geographic level below SPA (Service Planning Area).

Administrative fee for data

III.H. That a non-refundable fee of $750, in the form of a check made to "University of Michigan", has been provided to the Panel Study of Income Dynamics to cover the expenses of producing and shipping Data Files and documentation, of consulting, and of administering this agreement.

Archive work files

II.E. To store in secure locations all Data Files received from the Investigator pursuant to Section III.L. below, for a period of ten years following the date of receipt; original and backup copies, if clearly labeled as such by the Investigator, will be stored in separate locations if requested by the Investigator.

F. To send to the Investigator any Data Files not containing Restricted Data, received from the Investigator pursuant to Section III.L. below and stored in accordance with Section II.E. above, upon receipt of a written request from the Investigator for such Data Files, via "second day" parcel service.

G. To send to the Investigator any Data Files containing Restricted Data, received from the Investigator pursuant to Section III.L. below and stored in accordance with Section II.E. above, after approval by the Panel Study of Income Dynamics of a written request from the Investigator for additional analyses, via "second day" parcel service. A written decision on the request will be sent by first class mail either approving or denying the request, or specifying modifications that will lead to approval of the request.

Hostage project required

The investigator must meet requirements specified under either Category 1 OR Category 2.

Category 1. a) An individual who has a permanent, full-time, doctoral-level appointment and b) Principal Investigator of a grant funded by a US federal agency; or

Category 2. a) An individual who has a permanent, full-time, doctoral-level appointment and
b) Not a Principal Investigator on a grant funded by a US federal agency, and
c) Affiliated with a federally funded research center and d) Center Director and Principal Investigator of a federally funded Research Center agrees to serve as Co-Investigator.

Investigator requirements

I.A. "Investigator" is the person with a permanent full-time faculty-level affiliation with the Receiving Institution and is primarily responsible for analysis and other use of Restricted Data from the Panel Study of Income Dynamics.

B. "Co-Investigator" is a person with a permanent full-time faculty-level affiliation with the Receiving
Institution, required in cases in which the Investigator does not have such an affiliation.

III.F. That Receiving Institution will use its best efforts to insure that no persons other than those identified in this contract, or in subsequent amendments to this contract, as Investigator, Co-Investigator, or Research Staff, will be permitted access to the contents of Restricted Data files or any files derived from Restricted Data files.

Return/destroy media

III.G. That the Receiving Institution has reviewed and approved the research proposal summarized in the
Research Plan under its human subjects review policies and procedures, and that a copy of the approval
document has been provided to the Panel Study of Income Dynamics. Furthermore, Receiving Institution represents that is will maintain approval under its humans subject review policies and procedures for the entire time that the Data Files are in use.

I. To respond fully and in writing within ten working days after receipt of any written inquiry from the Panel Study of Income Dynamics regarding compliance with this contract or the expected date of completion of work with the Restricted Data and any data derived therefrom and to destroy Data Files and provide the certification described in subsection III G., above, upon written notice from the University of Michigan.

L. To return to the Panel Study of Income Dynamics all original and backup copies of Data Files, by "second day" parcel service, as follows:

1. Data Files containing Restricted Data within 180 days of the Investigator's receipt of those Data Files.

2. Files containing information derived from Restricted Data files, but not themselves containing Restricted Data, and the Census Extract PSID Subset Files and any files derived therefrom, within three years of receipt of the original files but in no case more than 60 days after completion of analysis using the data.

3. Files derived from Data Files and themselves containing Restricted Data, and originals and copies of those files, within five working days after receipt of a demand for return of such data from the Panel Study of Income Dynamics.

With each File returned, include a paper listing of the Data File name and the number, name, and brief description of the contents of each Data File (including whether or not the file contains Restricted Data).
